I. General Provisions
1. Scope
These General Terms and Conditions apply to table reservations at Rollercoaster Restaurant Vienna where either:
a menu or other gastronomic service is paid for in advance; or
a credit card is provided as a reservation guarantee.
The prices, services, dates and any special booking conditions displayed during the reservation process form part of the contract.
2. Conclusion of the Contract
By completing the online reservation process, the guest submits a binding offer to book the selected service.
The contract is concluded when the guest receives an electronic booking confirmation. For reservations requiring menu prepayment, successful payment is also required.
These General Terms and Conditions are made available to the guest before the reservation is completed. The guest must expressly confirm their acceptance within the reservation system.
3. Reservation Details
The guest is responsible for providing complete and accurate information when making the reservation. This applies in particular to the guest’s name, contact details, reservation date, reservation time and number of guests.
Any changes to the number of guests or other reservation details must be communicated to the restaurant in good time. A change becomes binding only once it has been expressly confirmed by the restaurant.
4. Prices and Payment
All prices are stated in euros and include the applicable statutory value-added tax.
Payment must be made using one of the payment methods offered through the reservation system. External payment service providers may be used to process payments.
II. Reservations Requiring Menu Prepayment
5. Menu Offering and Menu Selection
On certain dates, particularly public holidays, special events and themed evenings, the restaurant may offer exclusively pre-arranged menus.
The available menu options, such as meat, vegan or children’s menus, must be selected during the reservation process. The selected menu is binding.
Changes to the selected menu are possible only if expressly confirmed by the restaurant.
6. Prepayment
The full price of the selected menu must be paid in advance when completing the reservation.
The reservation becomes binding only after successful payment and receipt of the booking confirmation.
7. Cancellation by the Guest
The reservation may be cancelled free of charge no later than 14 calendar days before the reserved date. Any payments already made will be refunded using the original payment method.
For cancellations made after this deadline, the restaurant may retain a reasonable cancellation charge up to the total amount of the prepaid menu price.
The amount of the cancellation charge will be based on the financial loss reasonably expected to be incurred by the restaurant. Any expenses saved by the restaurant and any possibility of reallocating the reserved places will be taken into account.
The guest remains entitled to demonstrate that the restaurant suffered no loss or a substantially lower loss.
Any refundable balance will be returned using the original payment method no later than 14 days after the cancellation has been fully processed.
8. Failure to Attend
If the guest does not attend the reservation and the reservation was not cancelled within the applicable cancellation period, the reservation will be treated as a no-show.
In this case, the cancellation provisions set out in Section 7 apply accordingly. The cancellation charge is limited to the amount of the prepaid menu price.
Any expenses saved by the restaurant and any possibility of reallocating the reserved places will be taken into account. The guest remains entitled to demonstrate that the restaurant suffered no loss or a substantially lower loss.
9. No Statutory Right of Withdrawal
Under Section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is generally no statutory 14-day right of withdrawal for contracts concerning the supply of food and beverages or gastronomic services where the contract provides for a specific date or period of performance.
The possibility of cancelling free of charge up to 14 calendar days before the reserved date, as provided in Section 7, is a voluntary contractual cancellation policy offered by the restaurant.
III. Reservations with a Credit Card Guarantee
10. Scope of the Credit Card Guarantee
The following provisions apply to table reservations where no menu prepayment is required and a credit card is provided to secure the reservation.
11. Credit Card Details
A valid credit card capable of being charged must be provided when making the reservation.
The credit card is used solely as a reservation guarantee. The card will not be charged under the reservation guarantee if the guest arrives as agreed or cancels the reservation within the applicable cancellation period.
12. Cancellation Deadline
The reservation may be cancelled free of charge until 6:00 p.m. on the calendar day preceding the reserved date. Vienna local time applies.
The cancellation must be submitted using the online cancellation function provided by the reservation system or by email to office@rollercoasterrestaurant.com.
The time at which the cancellation is received by the restaurant determines whether the deadline has been met. A cancellation communicated solely by telephone is not sufficient and will not be considered a valid cancellation.
13. Late Cancellation and No-Show
If the reservation is cancelled after the deadline specified in Section 12 or if the guest fails to attend, the restaurant may charge the credit card provided with a flat-rate no-show fee of EUR 20.00 per reserved guest.
This fee is based on the financial loss typically incurred by the restaurant and takes typical saved expenses into account.
The guest remains entitled to demonstrate that the restaurant suffered no loss or a substantially lower loss. In such a case, the fee will be reduced accordingly or waived.
No amount exceeding EUR 20.00 per reserved guest will be claimed under this flat-rate fee provision.
14. Partial No-Show
If only some of the reserved guests attend, the no-show fee may be charged only for those guests who did not attend.
The guest remains entitled to demonstrate that the restaurant suffered no loss or a substantially lower loss.
15. Validity of the Credit Card
The guest is responsible for ensuring that the credit card provided is valid and can be charged if a fee is legitimately due.
A failed charge does not remove a payment obligation that has validly arisen under these Terms and Conditions.
16. Repeated No-Shows or Misuse of Reservations
In the event of repeated no-shows, deliberately incorrect reservation details or abusive multiple bookings, the restaurant may reject future reservations or accept them only against advance payment.
IV. Cancellation by the Restaurant
17. Cancellation or Inability to Provide the Service
If the restaurant is unable to provide the agreed service due to unforeseeable circumstances or circumstances beyond the restaurant’s reasonable control, including force majeure, official orders or comparable exceptional circumstances, the restaurant may cancel the reservation.
For reservations requiring menu prepayment, all payments already made will be refunded in full using the original payment method.
For reservations secured by a credit card guarantee, no cancellation or no-show fee will be charged.
Any mandatory statutory rights of the guest remain unaffected.
V. Liability
18. Liability of the Restaurant
The restaurant is liable in accordance with the applicable statutory provisions.
These General Terms and Conditions do not exclude or limit any mandatory statutory claims, particularly claims arising from damage caused intentionally or through gross negligence, or claims relating to personal injury.
VI. Data Protection
19. Processing of Personal Data
Personal data collected in connection with a reservation is processed in particular for the purposes of handling the reservation, performing the contract, processing payments, enforcing legitimate claims and complying with statutory retention obligations.
Where necessary for these purposes, personal data may be transferred to the reservation system provider, payment service providers and other contracted service providers.

VII. Applicable Law and Jurisdiction
20. Applicable Law
Austrian law applies.
For contracts concluded with consumers, this choice of law applies only insofar as it does not restrict any mandatory consumer protection provisions applicable in the country where the consumer has their habitual residence.
21. Jurisdiction
The statutory places of jurisdiction apply to consumers.
For contracts concluded with business customers, Vienna is agreed as the exclusive place of jurisdiction to the extent permitted by law.
